Pre-Conception & Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994–Secs. 3, 4, 5, 6, 23 & 25–Pre-Conception & Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Rules, 1996–Rules 9 & 10–Penal Code, 1860–Secs. 315 & 120-B–FIR against the petitioner was filed by the respondent no. 2-police officer–He was not competent to directly lodge the FIR under the provisions of PCPNT Act–Ingredients of offence u/ss. 315 & 120-B are found absent–Held, FIR is liable to be quashed and set aside, however, the respondents are free to proceed in accordance with law.
