Code of Criminal Procedure, 1973–Sec. 439–Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/29–Bail application–From the contents of the charge sheet, it is admitted case of the prosecution that no contraband was loaded in the vehicle in which the petitioner was travelling–He did not enter in the area of the concerned police station to escort the vehicle of the co-accused–He was not in the company of the co-accused from whom the contraband was recovered–No crime of escorting the vehicle was committed by the petitioner–Held, rigor to Sec. 37 are duly satisfied–Bail granted subject to certain conditions.
