the permission for amendment in written statement–Fact of execution of sale deed in favour of petitioner was in his knowledge at the time of filing written statement–Even if, it is presumed that the suit was filed prior to insertion of proviso to Section, the proviso would not be attracted, then also, the amendment sought after 12 years of transaction, canot be permitted to be incorporated–Application was rightly rejected.
