Code of Civil Procedure, 1908–Sec. 91–Trial Court deferred the objection with observing that the issue can be decided only after framing the same and examining it on merits–Trial Court failed to take notice of the provisions of Section in it’s true prospective–Impugned order set aside and matter remanded back for deciding afresh.
