Evidence Act, 1872–Sec. 65–Application under–Allowed–Justification–Case of respondent no. 3 that the petitioner sold the vehicle on the consideration of Rs. three lacs and a document was executed–He provided the photocopy of the document to police and still the original stamp remained in his possession but the same was not traceable–Case of the petitioner that he never executed the agreement–Photocopy of the document placed on the record indicates that it was not attested by any authority including notary–Execution of sale agreement is doubtful and it was not admitted–it could not have been permitted in evidence unless the conditions as prescribed u/s. 65(c) are satisfied–Impugned order is liable to be set aside.
