Penal Code, 1860–Secs. 307, 307/149, 452, 323 & 323/148–Arms Act, 1959–Sec. 3/25 & 3/27–Conviction–Sustainability–FIR reveals that eight persons were sitting in the vehicle whereas the complainant and PW 2 stated that six persons were sitting–It is also unbelievable that the vehicle ran over the footpath of 1.5 feet height–No injury was sustained by complainant and injuries sustained by the other injured are superficial–Contradiction as regard to breaking the glass of vehicle–Most of the witnesses were not present when the alleged incident occurred–Incident did not happen as alleged by the prosecution–No recovery from the possession of appellants–Witnesses are interested and having the criminal antecedent–Possiblity of false allegations due to prior enmity–Doubtful prosecution story–Appellants are entitled to be acquitted.
