Penal Code, 1860–Secs. 420 & 406–Order of taking the cognizance–Justification–Cheque issued by the petitioner way back in the year 2015 dishonoured–Complainant failed to avail the remedy u/s. 138 of N.I. Act–Exfacie the allegations set out by the complainant in the complaint do not constitute the necessary ingredients of the offence punishable u/ss. 406 & 420–Order of taking the cognizance and other consequential proceedings are liable to be quashed.
