Penal Code, 1860–Secs. 302 & 498-A–Acquittal–Appreciation of–PW 1 & PW 2 were present at the time of the incident but they did allege any of accused’s–Testimony of PW 3 was found uncorroborated–Panchnama showing that deceased put fired on herself by pouring kerosene–PW 5 was the witness of panchnama–Allegations levelled by him cannot be believed in view of his signatures on panchnama–Investigation agency also not found the involvement of accuseds in the commission of a crime–No cogent evidence to prove the charge of murder–Further, no allegation in regards to the demand of dowry–Held, the acquittal was justified.
