Workmen’s Compensation Act, 1923–Sec. 3–Compensation–Liability of paying–Deceased cleaner was employed on vehicle no. 7785–He met with accident when he was filling water in vehicle No. 5391–Both the vehicles were owned by the same person and were parked at same place–It can be safely stated that the deceased was filling water in the other truck only on the direction of employer–Insurance company was exonerated from liability on the ground that the appellant-owner failed to produce the insurance policy of vehicle No. 5391–However, he produced the Insurance Policy of vehicle No. 7785–Insurance Company of both vehicles is also same–Held, it would be proper to direct the Insurance company to indemnify the award to appellant.
