Code of Criminal Procedure, 1973–Secs. 439(2) & 438–Anticipatory bail–Cancellation of–While granting the anticipatory bail, Court below was of the view that the ingredients of offence u/s. 326 were not made out–Investigation is not over and weapon used in offence is yet to be traced out–It was too early to express the opinion merely on the ground of medical report–Bail deserves to be cancelled.
