Prevention of Food Adulteration Act, 1954–Sec. 7/16–Sample of chilly powder was found adultered–Rice structure was found in it–Chilly powder is not required to be examined by microscopic examination–Presence of rice structure do not bar the standard of chilly powder–It can not be held as dirt, extraneous colouring, flavouring matter or harmful substance–Held, prosecution amounts to an abuse of the process of Court and deserves to be quashed.
