Rajasthan Rent Control Act, 2001–Sec. 9–Execution of recovery certificate–Application for framing the issues and to permit for leading the evidence–Rejection of–In the earlier writ petition, this Court had observed that the petitioner has to resist the execution of the decree by way of appropriate application before the Tribunal–Observation of Tribunal that there is no necessity for proving the documents which have been filed in support of resistance application–Once the documents in support of the resistance application have not been admitted, the petitioner has to be provided the opportunity to prove them–Order deserves to be modified up to the limited extent of producing the evidence.
