Penal Code, 1860–Secs. 354 & 354A(1)(i)–POCSO Act, 2012–Sec. 7/8–Framing of charge–Justification–Charge framed u/s. 354 & 354(A)(1)(i) are akin to the allegation levelled u/s. 7 & 8 of POCSO Act–Once the offence would fall under the provisions of POCSO Act, and not under the Indian Penal Code, framing of charge under the provisions of Penal Code would not be justified–Charge u/ss. 354 & 354A(1)(i) deserve to be quashed.
