Rajasthan Rent Control Act, 2001–Secs. 6 & 9–Tribunal dismissed the application u/s. 9 for eviction, however, allowed the application u/s. 6 for revision of rent–Writ petition against–Allowed by Single Bench with the view that the statements of land-lady unrebutted by the tenant or anybody else in regard to personal & bonafide necessity were sufficient for granting the decree of eviction–Justification–Tribunal relied upon availability of a shop just adjacent to the rented premises and two other shops in another area–Tribunal also noticed the point the applicant concealed the fact about starting the business of same nature in earlier years and closure of that–Single Bench also not considered issue no. 5–Held, impugned judgment set aside and matter
remanded to Singh Bench for deciding afresh.
