Evidence Act, 1872–Sec. 65–Scope–In order to lead the secondary evidence, certain pre-conditions are required to be fulfilled, where such original document could not have been produced by the party relying upon such document in spite of best efforts, and was unable to produce the same which is beyond his control–Unless it is established that the original document is lost or destroyed or one being deliberately withhold by the party in respect of that document sought to be used, secondary evidence in respect of that document cannot be accepted.
