Code of Civil Procedure, 1908–Order 6, Rule 17–Denial from granting the permission to amend the plaint–Suit for recovery of money–Amendment was sought on the ground that the counsel inadvertently made the title of the suit wrongly as the loan was advanced by the company, therefore, the suit was required to be in name of company–Such inadvertent mistake cannot be refused to be corrected when the mistake is apparent from the reading of the plaint–Procedural defects and irregularities cannot be allowed to defeat the substantive rights–Impugned order set aside and amendment is allowed.
