Penal Code, 1860–Secs. 363, 366,376 & 377 [Corresponding Secs. 137(2), 87, 64 & (omitted) of BNS, 2023]–Acquittal by the Trial Court by giving the benefit of doubt–Reversed by the High Court–Appreciation of the testmony of the victim–Age of victim 15 years at the relevant time is not disputed–She specifically deposed before the Trial Court about the manner in which the incident took place–It is clear that she was subjected to sexual intercourse and she can be termed as a sterling witness–Doctors also stated that the medical evidence does not rule out the possibility of rape upon her–View taken by the High Court was the only possible view–No interference is required in the impugned order passed by the High Court.
