Code of Civil Procedure, 1908–Sec. 115 & Order 21, Rule 35–Execution of partition decree–Execution Court found the Will to be correct–In revision, High Court was viewed that the Will was surrounded by suspicious circumstances–Whether proper ?–Held, no–High Court interfered with the findings of facts in revisional jurisdiction–Further, the witnesses have deposed the execution of Will in favour of appellant–No one else has come forward to seek the execution of decree as a legal representative of the deceased decree holder–Appellant is the sole claimant to the estate of deceased on the basis of Will–Order passed by the Execution Court deserves to be restored.
