Code of Criminal Procedure, 1973–Sec. 311–Rejection of application–Appreciation of–Earlier the opportunity to lead the evidence was given subject to deposit the cost of Rs. 1,000/- –Petitioner did not deposit the cost and his evidence was closed–This Court allowed him to lead the evidence on the cost of Rs. 20,000/- –Again, no evidence was produced–Thereafter, he moved the application u/s. 311 which was also dismissed with the view that if further opportunity is given to him, same would tantamount to review of earlier order–Held, no illegality was committed by the trial Court in rejecting the application.
