Criminal Trial–Eye witness–Presence at the spot–Establishment–Star witness PW 10 remained silent for thirteen days after having seen the assault being made with the deceased–He claimed that his motor-cycle got punctured and he went to the field of appellants to park it–Why he did not go to the house of B which was nearby a half km. and proceeded to go to his own house after the appellants threatened him–This circumstance creates a doubt on the truthfulness of his testimony–Further, he is a handicapped person and there is no possibility to drag the motor-cycle by him for 6-7 km–Flimsy explanation is given by him–Held, he is not a reliable witness.
