Negotiable Instruments Act, 1881–Sec. 138–Constitution of offence in case the cheque is issued from the joint account and it bears the signatures of only one account-holder–The person who has issued the cheque, only he will be liable for the offence–Perusal of the cheque reveals that the cheque was issued by the signatures of M and present petitioner T has not signed it–This fact was not clarified in the complaint–Proceedings qua the present petitioner T are liable to be quashed.
