Penal Code, 1860–Secs. 420 & 406 [Corresponding Secs. 318(4) & 316(2) of BNS, 2023]–FIR for the offence–Sustainability–Claim of complainant that he purchased the house through a registered sale deed and the possession was handed over to him in the presence of witnesses, however, the petitioner re-entered the property under false pretext despite the sale deed confirming full payment and possession–Matter between the parties is simply of civil nature but has been given a criminal colour–There was no criminal breach of trust or cheating–FIR is liable to be quashed.
