Penal Code, 1860–Secs. 376/511–Establishment of offence–Statements of prosecutrix indicate that no attempt to rape has been made out by the appellant by committing any of the act as defined u/s. 375–Allegation that he took-off the inner wear of prosecutrix and also undressed himself–Such act does not amount to commission of offence u/s. 376/511–It is a case of offence u/s. 354–Conviction altered and sentence reduced up to the period of already undergone.
