Penal Code, 1860–Sec. 376 [Corresponding Sec. 64 of BNS, 2023]–Conviction–Appreciation of–There was no delay in reporting the incident and registration of FIR–The broken bangles were recovered from the place of incident–The blouse of the prosecutrix was seized with two butten broken–Her testimony remained consistent and unshaken during her cross-examination–Her version cannot be disbelieved merely on the ground of lack of injuries on her body including the private parts–It cannot be held to be indicative of her consent, particularly when her evidence is otherwise found to be credible and trustworthy–Her version is reliable and corroborated with the testimony of other witnesses–Argument that the witnesses are her closed relatives is liable to be rejected–Plea of false implication, taken by the appellant is not substantiated with any other evidence–Held, conviction was justified.
