Code of Criminal Procedure, 1973–Secs. 319 & 70–Scope–Whether the non-bailable warrants of arrest can be issued while exercising the power u/s. 319 ?–Held, unless there are very strong reasons for issuing non-bailable warrants of arrest, initially the alleged offender should be called through summons–Non-bailable warrant should be issued only when the accused refuses to appear–Court should indicate it’s reasons for disturbing the personal liberty of the offender.
