Limitation Act, 1963–Sec. 14–Code of Civil Procedure, 1908–Order 9, Rule 13–Rajasthan Rent Control Act, 2001–Sec. 9–Filing of regular appeal after challenging an ex-parte decree after the dismissal of application under Order 9, Rule 13–Whether the condonation of delay is permissible?–Held, no–In spite of knowlage that there was limitation for filing a regular appeal, petitioner chose to file the appeal after exhausting the remedy of filing a petition under Order 9, Rule 13 uptill the High Court only to delay the matter as much as possible and to frustrate the entire procceding–Further, leniency in such circumstances of present case involving rent petitions amounts to being harsh and unfair to the respondent and would result in setting wrong precedent and encouraging each and every tenant in rent matter to adopt similar method and modus of operandi to delay the finalization of an eviction matter–Interference declined in the impugned order of appellate Tribunal.
