Arms Act, 1959–Sec. 27–Conviction–Sustainability–Appellant was a police officer at the time of the commission of offence and ammunitions used for the offence were placed in his possession under the sanction accorded by the competent authority–It cannot be said that he used the unlicensed weapon–Illegal use of a licenced or sanctioned weapon per se does not constitute the offence u/s. 27–He is entitled to be acquitted from the charge u/s. 27.
