Judicial Officers Protection Act, 1850–Judges (Protection) Act, 1985–Code of Criminal Procedure, 1973–Secs. 156(3), 482 & 483–Suo moto cognizance–Criminal complaint against the former principal secretaries, law who have joined the post of Hon’ble Justice of High Court–Whether the complaint can be registered without prior permission of Hon’ble Chief Justice of Supreme Court ?–Held, no–Complaint neither disclosing the names of Hon’ble Judges nor a single word was stated in regard to their involvement–Only the principal secretary, law was impleaded–Magistrate forwarded the complaint without looking into it–FIR qua the Hon’ble Judges stayed and the Deputy Registrar (Judicial) is directed to register the matter u/ss. 482 & 483 Cr.P.C.–Other certain directions were also issued.
