Indian Partnership Act, 1932–Sec. 69(1)–Suit for recovery of money–View of High Court that the suit was not maintainable in view of bar contained in Sec. 69(1) as the partnership firm was not registered–Suit for recovery of amount was filed by a set of partners together on one side against another partner for the purpose of enforcing a right accruing under the agreement–Suit has not been instituted on behalf of firm against any third person so as to fall under the ambit of Sec. 69(2)–Rigors of Sec. 69(1) would apply–View taken by the High Court was correct.
