Code of Criminal Procedure, 1973–Sec. 438–While rejecting the anticipatory bail application, High Court issued the directions that the accused will surrender before the competent Court within four weeks and file an application for bail–Earlier, the trial Court had already been issued the nonbailable warrants–It released the accused on bail solely on the grounds of the direction issued by High Court–Whether proper ?–Held, no–Impugned order quashed and the matter remanded back for hearing on merits–Further held, High Court should refrain from passing such contradictory orders.
