Code of Civil Procedure, 1908–Order 7, Rule 14–Partly rejection of the application–Appreciation of–Trial Court rightly observed that if the plaintiff could not produce the documents mentioned in the plaint at that time and wanted to produce those mentioned documents later, than the Court could have considered the reasons for the delay in production and considered it to be relevant–No pleading has been made in the plaint regarding the documents Annex. 7 & 9–Further, no pleading has been made regarding the plaint being based on the above documents–Held, the Trial Court was quite justified is not taking these documents on record.
