Penal Code, 1860–Secs. 302, 201 & 376–Rape with minor girl aged of four years–Accused took away the prosecutrix by giving her peanuts and toffee, committed rape and murder–Prosecution case well proved by the testimony of witnesses and medical evidence–He failed to show any inconsistency or contradiction in the testimony of witnesses–Extra-judicial confession after 10-15 days–Chance chappal impression at the spot were found similar
with the specimen chappal of appellant–PWs. 4 and 5 were the material witnesses–But they were not cross-examined by accused–Held, conviction was justified.
