Narcotic Drugs & Psychotropic Substances Act, 1985–Secs. 8 & 17–Conviction–Appreciation–Recovery of 5.210 kgs. heroine–Contraband was recovered from a secret chamber of the jeep–Appellant was driving the jeep–Though two independent witnesses did not support the prosecution case, yet, they admitted their signatures on all the papers prepared at the spot–All the official witnesses stated in detail in regard to the interception of the jeep in question–Appellant failed to rebut the presumption drawn u/ss. 35 & 54–Compliance of provisions of Sec. 50 was not required as the contraband was recovered from the secret chamber made in the jeep–Seals of samples remained intact till reaching FSL–Few difference in weight of sample have no significance–Held, conviction was justified.
