Criminal Trial–Recovery–Reliability–Blood-stained shirt and pant were alleged to be recovered from the house of the accused–On the same day, bomboo stick was recovered from the house of N–Rojnamcha register and log book of the vehicle were not produced to establish the duty of police officers–No independent witness was involved whereas many persons of the village were alleged to be present–Witness stated that the bomboo stick was recovered from an open place and it was not blood-stained–It is also not clear that when the pant, shirt, and bamboo stick were recovered after two months, how the blood was deducted on these articles–Witness of malkhana was not examined by the prosecution–Delay in effecting the recovery after receiving the information–Recovered bed-sheet was not deposited in malkhana for a considerable period–It is also not clear as to why the accused would leave the bed-sheet on the spot and why the heavy stone was brought by him from the place of the incident–Recoveries are not reliable.
