Code of Civil Procedure, 1908–Order 7, Rule 11–Dismissal of application–Suit for cancellation of sale deed–Plaintiff avered that she resides in Jaipur and when she visited Kishangarh in January 2017, she come to know about the execution of sale deed–Admission that she knew about the encroachment in the year 2012 & 2016, is not sufficient to infer that she was having the knowledge of execution of sale deed–Held, it cannot be inferred from the plaint averments that the suit was hit by the provisions of limitation–Interference declined.
