Penal Code, 1860–Secs. 306 & 498-A–Distinction between both provisions–Abetment, comprehended u/s. 306 should be so much so that through pursuant to the cruelty in the former provision, the person thereto may commit suicide, the same would not per se prove abetment thereof by the accused to hold him guilty of the offence u/s. 306–The quality, content and degree of the evidence to prove the charge of abetment u/s. 306 against the accused thought found guilty of offence u/s. 498-A would have to be more clinching and consummate–Inference of abetment is not permissible even if evidence to prove the ingredients of Sec. 498-A are present.
