Penal Code, 1860–Sec. 86–Availability of protection–Not only the accused should be intoxicated but also the level of his intoxication be such as to render him incapable of knowing and understanding what he is doing or likely to do–Evidence to prove his incapacity to understand the nature of his action is mandatory to reduce the criminality of the accused.
