Rajasthan Municipalities (Urban Land Disposal) Rules, 1974–Auction
of land–Demand of 15% annual interest on the remaining 3/4 amount–Justification–After the auction proceedings had completed, respondent–municipality failed to provide the vacant possession to auction purchasers–Land was under encroachment and it was removed after the order passed by this Court in other writ petition–Due to long lapse of time, municipality became functus offico in the matter of finalising the sale–First notice for demand of 3/4 amount
was issued after eight years of auction–Successful bidder would be liable to deposit the balance amount only upon receiving the notice–Balance sale price could not have been applied retrospectively–Further, the municipality kept on enjoying the fruits of 1/4 amount without providing the plots–Held condition of demanding the 15% interest per annum is unjustified.
