Rajasthan Panchayati Raj Act, 1994–Sec. 111–Recovery proceedings–Sustainability–Mother of the petitioner was holding the post of Sarpanch–She expired on 13.04.2004–Notices of recovery were issued after her death–Neither any audit proceeding nor any inquiry was conducted till her death–Now, the respondents are in process of recovering the amount in question from the petitioners–It is not possible for the petitioners to reply with regard to the alleged act of misconduct committed by their mother–Disputed amount cannot be recovered from the legal representatives of the deceased-person until and unless any inquiry is conducted against the deceased and same can not be done because the petitioners were not aware about the irregularities or illegalities committed by their mother–Impugned warrants of attachment are liable to be quashed and set aside.
