Motor Vehicles Act, 1988–Secs. 149 & 3–Driver of offending vehicle was possessing the learner’s licence issued by the competent authority–Learner’s licence is a licence within the meaning of the provisions of Act–It cannot be said that a person holding a learner’s licence is not entitled to drive a vehicle–Respondent-Insurance Company failed to prove the breach of policy conditions–Held, it is directed to pay the amount of compensation to the claimants.
