Evidence Act, 1872–Secs. 45 & 73–Application under–Rejection of–Appreciation–Petitioners attempted to prove the execution of document which was executed in the year 1992–Execution of document was in knowledge of petitioners but they deliberately filed the application in question without explaining the delay–Further, the Trial Court has observed that the petitioner’s witness DW 5 has categorically stated that respondent no. 1 had executed the power of attorney in favour of N in his presence, therefore, no prejudice would be caused to the petitioners, if expert opinion is not brought on record–Held, petitioner failed to make out the reasonable ground for requirement of expert opinion–Application was rightly rejected.
