Penal Code, 1860–Secs. 306, 498A & 34–FIR for the offence–Prayer for quashing–Acceptability–Petitioner has been named in FIR–Complainant and material witnesses levelled serious allegations against the petitioner in their statements u/s. 161–FSL report gave the positive test of the presence of organo-phosphorous insecticide in the body of the deceased–Despite the specific allegations in FIR as regards to murdering the deceased and FSL report , the Investigation Officer has filed the charge sheet for the offences u/ss. 498A, 306 & 34 only against the co-accused N & M–Investigation Agency should inform the Court and seek formal permission to make further investigation–Impugned order dated 12.07.2023 passed by Trial Court has not been challenged before this Court–Held, no case is made out for quashing the FIR.
