Evidence Act, 1872–Sec. 32–Dying declaration–Consideration of–Governing principle–Court has to weigh all the attending circumstances and some on independent finding whether the dying declaration is properly recorded and whether it is voluntary and truthful and if on carefully scrutiny, the Court is satisfied that the dying declaration is true and free from any effort to induce and deceased to make a false statement and if it is coherent and consistent, there should no legal impediment to make it basis of conviction even there is no corroboration.
