Penal Code, 1860–Sec. 498-A [Corresponding Sec. 85 of BNS, 2023]–Probation of Offenders Act, 1958–Sec. 4–Code of Criminal Procedure, 1973–Sec. 360–While sentencing the appellants, the Sessions Judge and the High Court omitted to consider whether the appellants were entitled to the benefit of probation–Matter deserves to be remitted back for limited consideration of the question of grant of probation to the appellants upon obtaining a report of the concerned Probation Officer.
