Penal Code, 1860–Secs. 302/149, 323/149–Conviction–Proper Section and sustainable against whom ?–Six persons were convicted by trial Court–Both the deceased sustained several injuries–Similar version of witnesses–However, accused S was implicated falsely–FIR became delay in order to take the injured hospital–No extra-ordinary delay in sending the FIR to Magistrate–Appellant S caused sword injuries and other three accused caused injuries with lathes which were fitted with plates–Injuries were caused with
the intention to causing death–Held, appellants CS, CP, S & J are liable to be convicted u/s. 302/49–Appellants H & S and entitled for acquittal.
