Code of Criminal Procedure, 1973–Sec. 91–Trial Court allowed the application u/s. 91 during the pendency of trial and sought the documents pertaining the inquiry u/s. 174–Justification–Stage of investigation and inquiry is complete as the charge-sheet has been filed–Trial Court was under the obligation of rely only upon the police report and the documents submitted along with it–No further document could be presented in evidence after filing the charge-sheet–Impugned order is liable to be quashed and set aside.
