Rajasthan Public Trust Act, 1959–Sec. 29–Bar of suit–Applicability–Defendant’s written statement that the property in question was managed by two individual persons–In the last para of written statement, there was a cursory averment that the trust was not registered in terms of Act of 1959–No pleading whatsoever pertaining to Circular dated 28.06.1962–Such averments were first time made in the first appeal through the application under Order 6, Rule 17 but the application was dismissed as not pressed–Defendant has not made any valuation of the property and no evidence was produced over this issue–Trial Court rightly declined to enter into the question to determine the issue as to whather the trust in question was public or private and whether it was compulsorily required to be registered in terms of Act of 1959.
