Code of Civil Procedure, 1908–Order 9, Rule 13–Ex-parte order and decree were passed without assuring the fact that the A.D. of summon or the envelop has been returned–Trial Court failed to call any report from it’s staff as regard to this fact–Held, ex-parte decree is liable to be set aside subject to certain conditions.
