Criminal Trial–Accused was neither named in FIR nor police statement–Related witnesses stated that they alleged the accused R in FIR and police statements, however, no explanation was furnished in regard to missing of the name–Other five accused were categorically named–Independent witnesses did not name the accused R directly–Held, R was rightly extended the benefit of the doubt by High Court.
