Code of Civil Procedure, 1908–Order 1, Rule 10–Rejection of application–Suit for cancellation of sale deed was pending at appellate stage–Petitioners are the purchasers of land from power of attorney holder–No application for impleadment was moved at any stage before the trial Court–Dispute between the parties is only relating to cancellation of power of attorney and for adjudication of the said dispute–Applicants who are the beneficiaries and have purchased the property through sale deed executed by the power of attorney holder canot be said to be necessary parties, however, they can be
considered as proper parties–Application deserves to be allowed.
